Terms of Service - Hooq

1. Introduction
These Terms of Service ("Terms") govern the use of the Hooq application ("Hooq" or "the App"), a Forge-based app available via the Atlassian Marketplace and designed for Jira Cloud.
By installing or using Hooq, you agree to these Terms.
If you do not agree, do not install or use the App.
2. Description of Service
Hooq enables synchronization of Jira issues between two Jira Cloud instances or within the same instance.
Hooq operates within Atlassian Forge infrastructure and interacts with Jira Cloud through permissions granted during installation.
Hooq does not operate external servers for core synchronization processing.
3. Eligibility
You must be authorized to install and manage apps within your Jira Cloud instance.
You are responsible for ensuring that your use of Hooq complies with your organization's policies and applicable laws.
4. Customer Responsibilities
You are responsible for:
- Configuring connectors between Jira instances.
- Granting appropriate permissions to the app.
- Reviewing synchronization mappings before activation.
- Ensuring that data shared between connected instances is authorized.
Hooq only synchronizes data between instances explicitly configured by administrators.
5. Security and Encryption
Hooq uses cryptographic mechanisms to establish secure communication between connected Jira instances.
Each installation generates its own cryptographic materials, which are stored securely within Atlassian Forge storage.
Shared secrets and private keys are not visible to administrators and are not accessible to the Hooq team.
You are responsible for protecting administrative access to your Jira Cloud instance.
6. Support and Troubleshooting
To investigate technical issues, we may request that you generate and share a Support ZIP file.
The Support ZIP file may include:
- Connector configuration metadata
- Synchronization settings
- Error logs related to Hooq execution
- Diagnostic metadata
The Support ZIP file does not intentionally include full Jira issue content unless explicitly required and approved for troubleshooting.
You are responsible for reviewing the contents of the Support ZIP file before sharing it with us. Support files are used solely for troubleshooting and are not retained longer than necessary to resolve the issue.
7. Data Ownership
All Jira data processed by Hooq remains the property of the respective Jira Cloud instance owners.
Hooq does not claim ownership of customer data.
8. Data Processing
Hooq processes data only as required to perform configured synchronization actions.
Hooq does not:
- Sell customer data
- Use customer data for advertising
- Collect behavioral analytics
Data transmission occurs only between Jira instances that administrators explicitly connect.
9. Service Availability
Hooq relies on Atlassian Forge and Jira Cloud infrastructure.
We are not responsible for outages, interruptions, or performance limitations caused by Atlassian platform availability.
We may update, modify, or improve Hooq functionality at any time.
10. Limitation of Liability
To the maximum extent permitted by law:
Hooq is provided "as is" without warranties of any kind.
We are not liable for:
- Misconfiguration of connectors
- Unauthorized sharing of data between instances
- Data loss resulting from incorrect synchronization rules
- Indirect, incidental, or consequential damages
Total liability shall not exceed the amount paid for the app subscription during the previous twelve (12) months.
11. Indemnification
You agree to indemnify and hold harmless the Hooq team from claims arising out of:
- Misuse of the App
- Violation of these Terms
- Unauthorized data sharing between connected Jira instances
12. Termination
You may terminate use of Hooq at any time by uninstalling the App.
Upon uninstallation, Forge-managed storage associated with the app will be removed according to Atlassian's platform lifecycle.
13. Modifications to Terms
We may update these Terms periodically.
Continued use of Hooq after updates constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
